These Terms of Service ("Terms") govern your access to and use of RapidVerify's verification API, dashboard, sweepstakes-compliance tooling and DriveScan MVR underwriting engine (the "Service"). By creating an account or calling our API, you agree to these Terms.
1. Who can use the Service
- You must be at least 18 years old and authorised to bind your organisation.
- You're responsible for all activity under your account, including API keys you issue to team members or third parties.
- One person may not maintain multiple accounts to circumvent quotas or pricing.
2. The Service
RapidVerify provides software tools; it does not act as a credit reporting agency, licensed insurance underwriter, gaming operator, sweepstakes sponsor or provider of legal advice. In particular:
- Verification API returns advisory verdicts based on the data you submit and the eligibility rules you configure. You are responsible for the accuracy of your rules and for any adverse action taken based on a verdict.
- Sweepstakes module generates official-rules templates, tracks entries, runs drawings and stores W-9s. You (the sponsor) remain the promoter of record and are responsible for state bond filings, 1099 issuance and all substantive compliance under 18 U.S.C. § 1301, state lottery laws and FTC guidance.
- DriveScan extracts MVR data and scores it against carrier rules you configure. Verdicts are advisory. RapidVerify is not a consumer reporting agency; if you use MVR data for employment decisions you must comply with the Fair Credit Reporting Act (FCRA) and use a licensed CRA where required. RapidVerify is not that CRA.
3. Acceptable use
You agree not to:
- Submit data you don't have the right to submit, or use the Service to build a competing verification database.
- Reverse-engineer, resell or sublicense the API without a written agreement.
- Use the Service to violate the FCRA, GDPR, CCPA, TCPA, state lottery laws or any other applicable law.
- Attempt to exceed the rate limits or quotas of your plan by circumventing enforcement.
- Upload malware, illegal content or attempt to compromise the platform.
We may suspend accounts we reasonably believe are violating these rules.
4. Plans, billing & cancellation
- Free-tier accounts have monthly quotas visible in the dashboard. Paid plans are billed monthly in advance via Stripe.
- You can upgrade, downgrade or cancel at any time via the Billing → Manage subscription flow (Stripe hosted portal).
- Payments are non-refundable except where required by law or expressly stated in writing.
- We may change pricing on 30 days' notice; changes never apply retroactively to a paid period.
5. Data ownership & privacy
You retain ownership of all data you submit ("Customer Data"). You grant us a limited license to process it solely to deliver and improve the Service. Our handling of personal data is described in the Privacy Policy. On termination we will delete your Customer Data within 30 days unless retention is required by law.
6. Third-party services
The Service integrates with third-party providers (Stripe, Resend, OpenAI, Google Gemini, MongoDB Atlas, PostHog). Your use of those integrations is subject to their own terms. We are not responsible for outages or errors introduced by third parties.
7. Warranty disclaimer
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose or non-infringement. Verification verdicts, MVR scoring and compliance templates are advisory and do not constitute legal, tax, insurance or eligibility determinations.
8. Limitation of liability
To the fullest extent permitted by law, RapidVerify's aggregate liability arising out of or related to these Terms will not exceed the amount you paid us in the 12 months preceding the claim. In no event will we be liable for indirect, incidental, special, consequential, punitive or exemplary damages, including lost profits or lost data.
9. Indemnification
You will indemnify and hold RapidVerify harmless from third-party claims arising out of (a) your Customer Data, (b) your use of the Service in violation of law or these Terms, or (c) your sweepstakes or underwriting decisions.
10. Termination
Either party may terminate for convenience with 30 days' notice. We may suspend or terminate immediately for material breach or non-payment. Sections 5–9, 11 and 12 survive termination.
11. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Delaware, and each party waives any objection to that venue. Nothing in this section limits either party's right to seek equitable relief in any court of competent jurisdiction.
12. Changes to these Terms
We may update these Terms; material changes will be announced in the dashboard or by email at least 15 days before they take effect. Continued use after the effective date constitutes acceptance.
